Lawyer & Workplace Investigator
Amanda Driscoll's practice encompasses independent external workplace investigations, culture audits and investigation training for employers and human resource professionals.
Amanda regularly conducts workplace investigations into allegations involving workplace harassment, including code-based, psychological and sexual harassment, bullying, discrimination, including Anti-Black Racism, unconscious bias, and micro-aggressions, workplace violence, employee theft, fraud, code of conduct breaches, and other misconduct.
Amanda takes a sensitive approach to all parties and witnesses, recognizing the importance of confidentiality and respect. Amanda produces workplace reports which clearly set out the evidence collected and her analysis of that evidence, leading to her findings of fact. When requested, Amanda also provides an assessment of whether any applicable workplace policies have been breached and/or recommendations for remedial/corrective action, in addition to those aimed at restoring the workplace/ working relationships.
Amanda has extensive investigative and regulatory compliance experience. Prior to joining Mortimer Khoraych, Amanda was a workplace investigator at a leading national workplace investigation firm. There, she conducted complex, high-stake, and sensitive workplace investigations for a wide range of employers and organizations. Amanda also spent three years as an ombudsman investigator, where she regularly mediated resolutions with diverse and multi-party stakeholders.
Amanda is well known for her work and expertise in Indigenous issues. Amanda started her legal career as a staff lawyer with Aboriginal Legal Services (formerly Aboriginal Legal Services of Toronto). While at ALS, Amanda provided legal advice and representation to Indigenous clients on matters involving human rights, disability appeals, criminal injuries compensation, and coroner’s inquests. Amanda also appeared before the Supreme Court of Canada and the Court of Appeal for Ontario on matters of significant importance to the Indigenous community.
Amanda completed her Juris Doctor at Osgoode Hall Law School. She was called to the Ontario Bar in 2010. Prior to law school, she graduated from Carleton University with a B.A. Hons., in English and Law. Amanda holds a certificate in Education Law from Osgoode Hall Law School. Amanda is the secretary and volunteer member of the Forest View Public School Community Council.
